What they do is start putting property and other assets in someone else’s name thinking it will make them “judgment proof”. What we do is find all these assets through exclusive-use database searches and interviews and then trace the dates to see when the subject transferred the asset to someone else. If they did this after the lawsuit was filed or after the event that caused the lawsuit happened – in anticipation of the lawsuit – a judge can likely rule it a “Fraudulent Conveyance”. A judge will usually penalize the subject accordingly, even to the extent of allowing you to take ownership of the property.
